Terms and Conditions

The following terminology applies to this Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “You” and “Your” refers to you, the person accessing this contract and accepting Fanciful Celebrations Terms and Conditions. “Ourselves,” “We,” and “Us,” refers to Stacey Jackson and/or Fanciful Celebrations (FC).  “Party,” “Parties,” or “Us,” refers to both the Client and ourselves, or either the Client or ourselves.  Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

OUR SERVICES

Fanciful Celebrations designs and creates luxury party accommodations to locations in and surrounding Lynwood, WA. You understand and acknowledge that information listed in this contract related to each party including descriptions and photographs are for informational purposes only and are not guaranteed to look the exact way they are shown on our website or social media platforms. Each picnic experience will be different. Each of the locations used in connection with the picnics may employ their own rules, conditions, waivers and other obligations with which You must comply, including dress code, footwear and alcoholic beverage and food consumption restrictions. You understand and acknowledge that You have complete oversight over Your person and property throughout Your participation in any picnic related activities and as such release Us from all liability related to activities that are wholly under Your control.

 

You understand and acknowledge that due to circumstances beyond our control, We may be required to change vendors used as add-ons from time to time; if such a change results in a material change to the nature or type of food or rental items included in our luxury experience purchased by You, We will contact You promptly of the substituted food/items.  Notwithstanding anything to the contrary in these Terms and Conditions, in the event that such substituted food or items are not acceptable to You for any reason, You may not obtain a refund for Your purchase, but You may schedule a different, comparable picnic experience at the sole discretion and approval of FC.

LUXURY TEEPEE SLEEPOVER PARTIES

​FC provides Teepee rental is for a 24-hour period. 

FC will set-up the party and return the next day to pick up the teepees at an agreed time, if the equipment is not available for pickup (ie. no one home), we reserve the right to charge for the extra time.

FC requires 2 hours to fully set-up the party. Tear down takes approximately 1 hour. FC will not clean up trash or other debris from the party. We pick up our equipment and rental items only.

PRIVATE RESIDENCE  

Please make sure you have an open area, a clutter free room, and a safe space for the guests to sleep. It is your responsibility to make sure there is enough space to accommodate the teepees with an open and unobstructed walkway to allow your guests to get in and out of the teepees safely. The overall width of the teepee with twin sized blowup mattress is approximately 3.5 feet wide per tent. The length of each mattress is 75” long. We generally set up the tents next to each other or opposite of each other, depending on the space. ​The large airbeds are 75" long and 39" wide. The large teepee is 39" wide and 39" long. Height is 60".

Each decorated teepee includes an airbed, fitted sheet, light blanket, decorative cushions, pennant/banner, lantern, fairy lights, name sign, and tray.

HEALTH & SAFETY

FC will launder all of the blankets, linens and decorative cushions after the party. We use detergent that is hypoallergenic. The airbeds and trays are also sanitized.

BOOKING FEE/SECURITY DEPOSIT

A Booking Fee/Security Deposit will be charged prior to the Client's event date. Deposit amount will vary depending on the total cost of FC Luxury equipment rented out, this will be clearly stated as part of the Client quote. All fees and expenses associated with your booking must be paid in full prior to your luxury experience. The Client is responsible for the safe keeping of the equipment at all times during the rental period (including not leaving the equipment unattended if in a public space). You agree to pay for any damages incurred during Your luxury experience, including but not limited to unreasonable clean up, etc. FC will charge the Client full replacement value for any lost, broken, damaged or destroyed equipment - this may exceed the security deposit amount. We reserve the right to retain the security deposit if there is a cancelation or damage or loss occurs.

 

Deposits will be retained for a cancelation of the event by the customer.

PAYMENT

All payments are non-refundable and non-transferrable. In the event Client fails to remit payment as specified, FC shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and no longer assist Client. FC will charge the Client full replacement value for any lost, broken, stained, damaged or destroyed equipment - this may exceed the security deposit amount. All fees and expenses associated with your picnic booking must be paid in full prior to your picnic experience. You agree to pay for any damages incurred during Your picnic experience, including but limited to broken items, soiled items, etc.  

 

ADDITIONAL GUEST[S]

Additional Guest 

Each package is for a set amount of guest and identifies the cost of adding additional guest. Children under the age of 2 can attend free of charge. 2 years and older will require adding on an additional guest.

PRICING/PACKAGES

FC Luxury Picnics is allowed to update pricing or make any changes on the website at any time. Pricing and packages are subject to change. Prices quoted at time of inquiry will be honored for 30 days.

 

LIABILITY TO THIRD PARTIES

FC will not be liable relating to any injury, illness, death, loss or damage on the Client or the Client’s property that may occur during bookings. The Client is voluntarily participating in this activity. The Client is participating in this activity entirely at their own risk. The Client understands that injuries or outcomes may arise from their own or others negligence. The Client agrees to voluntarily give up or waive any right that they otherwise have to bring a legal action against FC for personal injury or property damage. In the event that the Client should require medical care or treatment, they agree to be financially responsible for any costs incurred as a result of such treatment. The Client is aware and understands that they should carry their own health insurance.

ALL ADD-ONS / ENHANCEMENTS

Enhancements (add-ons) may be requested up until one week before the picnic date. All requested add-ons must be paid within one week of booked picnic date or there is no guarantee the add-ons will be available.

Note: Simply Fanciful Boho Picnic package for 2 does not include additional enhancements.

 

SCHEDULED AGREEMENT / The Duration of Your Booking

While we're here to make your day easier and help you create beautiful memories, we ask that you respect our time and arrive at the agreed time. We may have other bookings we need to get to, and if you're late it affects our whole schedule. We also want your picnic as fresh as possible and if you arrive an hour late, we cannot guarantee the food will still be at it's best! Please let us know as soon as you know you are delayed.

At an hour we have the right to pack up the picnic without refund. Please also note that your picnic time starts from the originally agreed time whether you are late or not.

Should you need to leave earlier than the duration of your booking, we require 30 minutes notice. Should clients choose to leave early, FC will not offer any refunds for leaving the event earlier than anticipated. Please do not leave our items unattended. During the event, clients are held responsible for our picnic items until we return to clean up.

 

PRIVATE RESIDENCE  (INDOOR OR OUTDOOR)

The Client is responsible for clearly indicating the location of the assembly or dismantling of the equipment. Prior to FC arrival, the Client must ensure the area is clear of all furnishings and personal belongings and all floor/grass areas are clean (vacuumed/mopped, clean). FC will take every care during set-up/tear-down, but shall not be liable for any damage to the Client’s site, access areas, furniture, flooring or personal belongings. No animals or smoking is permitted on or around the area the rental equipment is set up.

 

CANCELLATION, REFUND, & DAMAGES POLICY

FC does not offer refunds for any picnic once payment has been received. If there is a cancelation that occurs, we reserve the right to retain the security deposit. Should You need to reschedule Your picnic for any reason, You must do so within one week of your scheduled picnic date. If You miss a scheduled picnic for any reason, and You have not already undertaken to reschedule the picnic with FC in accordance with these Terms and Conditions, the picnic will be considered forfeited and all payments You have made in connection with such picnic shall be surrendered.

Your use of any information or materials on this website is entirely at Your own risk, for which We shall not be liable. It shall be Your own responsibility to ensure that any products, services or information available through this website meet Your specific requirements.

 Should any items used during your picnic experience provided by FC be damaged, We reserve the right to collect charges associated with damage or extra cleaning. You will be sent an invoice for damaged items and expected to pay said in within five (5) business days from the invoice date.

Pacific Northwest weather is often unpredictable and ever changing. FC has included a Bubble Tent for those wonderful rainy days we have in Seattle. Most Companies charge an additional fee for these tents. Our service includes the tent to give our guest the best experience possible. This is the quality and value we want our customers to experience. If the weather is windy or stormy we recommend having a backup picnic location (preferably indoors) where we can continue the event as planned. We cannot refund payments due to weather cancellations, but we can reschedule according to availability.

PET POLICY

Pet hair can cause our guests discomfort and or allergic reactions. Because of this, we ask that no pets attend the picnic. If pet hair is found on our rental items, the items will have to be professionally cleaned and therefor we will charge cleaning fee’s out of the deposit.

IMAGE RELEASE

In the event that photographs of Your Picnic Package have been taken and shared either

on social media or with Us, FC reserves the right to use such photographs

in its promotional materials. 

 

CODE OF CONDUCT

By purchasing a picnic experience, You agree that You will conduct Yourself in an appropriate manner throughout the course of Your participation.  You agree that You will not engage in activity or behavior that:

1. (a) is untrue, inaccurate, defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person; (b) is bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms or can reasonably be expected to harm any person or entity;

2. violates the rules or codes of conduct of the location, including excessive intoxication or consumption of alcoholic beverages when consumption of alcoholic beverages is expressly forbidden;

3. is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them, including drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity;

 We cannot and do not assure that other participants or other visitors of Your location are or will be complying with the foregoing Code of Conduct or any other provisions of these Terms and Conditions, and, as between You and Us, You hereby assume all risk of harm or injury resulting from any such lack of compliance.

ALCOHOLIC BEVERAGES

We do not have a license to sell alcohol and will not provide any.

Our state/public parks and beaches are very strict and on consuming alcohol in public areas. Unfortunately, we cannot provide alcoholic beverages and you may want to check with the regulations and laws in your desired area if you decided to bring your own.

The client will be responsible for obtaining all the required approval / permission  from  the  appropriate authorities  as  may  be  required  and  will  bear  full responsibility  for any  fines,  punishment, legal fees and any loss, direct or consequential, arising there from.

 

ALCOHOL AND ILLEGAL DRUGS

FC has a longstanding commitment to provide a safe, quality oriented and productive work environment. Alcohol and drug misuse poses a threat to the health and safety of our clients, team members, and to the security of the company's equipment and facilities. For these reasons, FC is committed to the elimination of drug and alcohol misuse by team members, clients and/or guests. 

 

FC prohibits using, possessing, buying, selling, manufacturing or dispensing an illegal drug (to include possession of drug paraphernalia) on a designated picnic locale, indoors or outdoors.

 

It is against park rules to drink or display the use of alcohol, cannabis, and illegal drugs in a public place at any time and are prohibited in city and county parks and the surrounding Puget Sound area.

 

The client will be responsible for obtaining all the required approval / permission  from  the  appropriate authorities  as  may  be  required  and  will  bear  full responsibility  for any  fines, punishment, legal fees and any loss, direct or consequential, arising there from.

 

AMERICANS WITH DISABILITIES ACT

FC regretfully makes no warranty or representation as to whether or not the picnic locations or any of the activities comprising the picnic experience comply with the Americans with Disabilities Act (ADA) or any similar legislation. However should you have any special needs or requests for your picnic experience, please make this known upon booking and we will do our best to serve you.

 

INTELLECTUAL PROPERTY

You acknowledge that the services We provide as part of FC are protected by copyright, trademark, trade secret and other laws of the United States. Except as expressly authorized herein, You may not reproduce, transmit, sell, display, distribute, publish, broadcast, circulate, modify, disseminate or commercially exploit the website, mobile app, and any and all content produced by Us in any manner (including electronic, print or other media now known or hereafter developed) without our written consent. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary-rights notices incorporated in or accompanying any of Our products, services or in any of Our content.

You have a non-exclusive, revocable license to access any of Our content for Your personal use, including this website, on the express condition that You comply with the terms of these Terms and Conditions.

PLEASE BE ADVISED, OUR RENTAL AGREEMENT WILL BE AMENDED TO THE FOLLOWING TERMS AS THE COVID-19 OUTBREAK CONTINUES:

 

FC Luxury Picnics team members wants our customers and guests to feel 100% comfortable. We place your health and safety as our top priority. Here are the steps we’re taking to help everyone feel safe:

â—¾ All surfaces are sanitized before and after each picnic.

â—¾ All pillowcases and blankets are washed after each picnic.

â—¾ Dinnerware and drinkware are washed after each picnic.

â—¾ All silverware are washed after each picnic.

â—¾ Our team members wear gloves and masks when handling all picnic items.

â—¾ We provide hand sanitizer at each picnic.

â—¾ When greeting clients or setting up and tearing down picnics our team members will wear face masks and gloves and keep a distance of 6 feet apart. 

We reserve the right to cancel or reschedule any event if community cases rise causing concern or if Our team members exhibit or has been in contact with person(s) exhibiting symptoms of Covid-19.

We make no assumptions or claims in connection with our vendors and add-ons regarding Covid 19 precautions and standards.
